Casafix – General Platform & Service Regulations (Switzerland)

These General Platform & Service Regulations ("Regulations") govern the use of the Casafix platform, website, mobile applications, and all services provided directly or indirectly under the Casafix brand.

Casafix is operated by Casafix, sole proprietorship / company registered in Switzerland, with its registered address in Switzerland ("Casafix").

By accessing, registering, booking, or providing services via Casafix, users expressly agree to these Regulations.

1. Scope & Business Model

Casafix operates under a hybrid service and platform model.

Casafix may:

  • Provide services directly to clients through Casafix-employed professionals, and/or
  • Act as an intermediary platform connecting clients with independent professionals who perform services in their own name and on their own responsibility.

The applicable model depends on the specific booking and professional involved.

2. User Categories

These Regulations apply to the following user categories:

2.1 Clients

Natural or legal persons who book services via Casafix.

2.2 Employed Professionals

Professionals employed by Casafix under a separate written employment contract.

2.3 Independent Professionals

Self-employed individuals or companies registered as independent service providers who use Casafix as a platform to offer services to clients.

3. Service Provision

3.1 Services Provided by Casafix

Where services are delivered by Casafix-employed professionals, Casafix is the contractual service provider and assumes responsibility for:

  • Proper execution of services
  • Salary payment
  • Social security contributions (AHV/IV/EO)
  • Accident insurance (UVG)
  • Statutory holiday entitlements

3.2 Services Provided by Independent Professionals

Where services are delivered by independent professionals:

  • The service contract is concluded directly between the client and the independent professional
  • Casafix acts solely as an intermediary and payment facilitator
  • Independent professionals:
    • Are free to accept or reject jobs
    • Set their availability independently
    • Operate at their own economic risk
    • Are responsible for their own insurance, taxes, and social security

4. Employment Conditions (Employed Professionals)

4.1 Remuneration

  • Employed cleaners are paid on an hourly basis
  • Gross hourly wage: CHF 30
  • Salary is paid monthly on the 24th

4.2 Working Time

Working hours depend on assigned bookings and client demand.

4.3 Holidays

  • Statutory minimum holiday entitlement applies (minimum 4 weeks per year, or 5 weeks if under 20 years of age)
  • Holiday pay is handled in accordance with Swiss labour law

4.4 Insurance

Casafix provides:

  • Mandatory accident insurance (UVG)
  • Employer contributions to AHV/IV/EO and other statutory schemes

5. Independent Professionals – Legal Status

Independent professionals confirm that:

  • They are genuinely self-employed under Swiss law
  • They are not subject to Casafix's instructions regarding working time or job acceptance
  • They bear full responsibility for:
    • AHV registration
    • VAT obligations (if applicable)
    • Accident, liability, and professional insurance
  • Casafix does not guarantee a minimum number of jobs.

6. Booking, Payments & Fees

6.1 Booking

Bookings are made via the Casafix platform and are binding once confirmed.

6.2 Payments

  • Client payments are processed through Casafix
  • For independent professionals, Casafix may deduct a service commission
  • For employed professionals, Casafix invoices the client directly

6.3 Invoices

Invoices are provided electronically unless otherwise agreed.

7. Cancellations & No-Shows

  • Cancellation terms are communicated at the time of booking
  • Late cancellations or no-shows may result in fees
  • Professionals may decline future bookings in case of repeated misconduct

8. Liability

8.1 Casafix Liability

Casafix is liable only for damages caused by:

  • Gross negligence
  • Intentional misconduct

Casafix is not liable for:

  • Indirect or consequential damages
  • Services performed by independent professionals beyond platform mediation

8.2 Independent Professionals

Independent professionals are solely liable for damages arising from their services.

9. Insurance & Damages

  • Clients must ensure safe access to the service location
  • Damage must be reported within 48 hours
  • Insurance coverage depends on the applicable service model

10. Data Protection

Casafix processes personal data in accordance with:

  • Swiss Federal Act on Data Protection (FADP)
  • Applicable data protection regulations

11. Suspension & Termination

Casafix may suspend or terminate accounts in case of:

  • Breach of these Regulations
  • Fraudulent activity
  • Abuse of the platform

12. Amendments

Casafix may amend these Regulations at any time. Updated versions become binding upon publication.

13. Governing Law & Jurisdiction

  • These Regulations are governed exclusively by Swiss law.
  • Exclusive place of jurisdiction is the registered seat of Casafix, Switzerland.
